Uttarakhand Set to Enact Uniform Civil Code: A Step Towards Legal Harmony

In a significant development, Uttarakhand Chief Minister Pushkar Singh Dhami announced on Monday that a five-member expert committee, led by retired Supreme Court Justice Ranjana Desai, will be submitting the draft for a Uniform Civil Code (UCC) on February 2.

The UCC aims to bring uniformity to laws across various faiths, covering crucial areas like marriage, divorce, inheritance, and maintenance.

Commitment to a Pledge In a video statement on social media, CM Dhami emphasized, “Bringing a Uniform Civil Code was our pledge to the people.” This move aligns with the Bharatiya Janata Party’s (BJP) longstanding commitment, along with other key initiatives like the construction of the Ram Mandir and the abrogation of Article 370.

Assembly Session for UCC Bill Dhami further revealed that a special one-day assembly session will take place on February 5 to discuss and pass the UCC bill after the expert committee submits the draft. The committee, which includes experts like Justice Pramod Kohli, former chief secretary Shatrughan Singh, Vice-Chancellor Surekha Dangwal, and social worker Manu Gaur, has completed its work.

Implementation Before Lok Sabha Elections CM Dhami reiterated his government’s commitment to implementing the UCC in line with Prime Minister Narendra Modi’s vision of ‘One India, Best India’ before the upcoming Lok Sabha elections. The groundwork for this initiative was laid in 2022 when plans for UCC implementation were announced during the inaugural cabinet meeting.

Gender Equality Emphasized The expert committee’s report underscores the significance of gender equality and equal rights for daughters concerning ancestral properties. This aligns with the broader goal of ensuring fairness and justice in the application of the Uniform Civil Code.

Future Implications Insights suggest that after Uttarakhand’s Legislative Assembly passes the UCC bill, Gujarat and Assam, both BJP-ruled states, may follow suit. If this unfolds as anticipated, three states could enact the Uniform Civil Code before the 2024 Lok Sabha elections, marking a significant step towards legal harmony in the country.
